Josh Duggar Update: Government Responds To New Trial Request
Former TLC star Josh Duggar’s legal team previously filed a motion for an acquittal or a new trial. That was several weeks ago, and the government now has a response for the eldest of Jim Bob and Michelle Duggar‘s 19 children. So, is Josh getting a new trial, or is he moving on to sentencing in just a couple of months?
In the spring of 2021, Josh was arrested for the possession of child pornography. In November, his case went to trial. The former 19 Kids & Counting star claimed he was innocent. However, after a couple of weeks in court, he was found guilty on two counts. He’s now awaiting sentencing and is facing up to 20 years behind bars and up to $250,000 in fines on each count.
A sentencing date has yet to be set. When he was found guilty in early December, it was reported sentencing would be in about four months. So, it should happen soon.
Josh’s wife, Anna Duggar, recently shared his legal team’s motion in which he requested a new trial. The Duggar daughter-in-law shared a link to the document while claiming, “There is more to the story.”
Now, the government has responded to Josh Duggar’s defense’s motion.
Is Josh Duggar getting a new trial?
In the court documents responding to Josh Duggar’s request for a new trial, the prosecution claims, “The evidence of the defendant’s guilt is clear and overwhelming.”
The documents also read, “The defendant, for his part, claimed that someone else did it, but his attempts to scapegoat others collapsed under the mildest scrutiny. His own expert largely agreed with government’s explanation of the facts and, when given the chance to rebut evidence placing the defendant at the computer, conceded that she could not.”
They continue, “Further, when given the chance to substantiate his speculative defense with other witnesses, the defendant instead rested his case. The Court should deny the defendant’s motion in its entirety.”
