Erika Girardi Getting Hit With Another Fraud & Embezzlement Lawsuit?
As TV Shows Ace previously reported, the court cleared Erika Girardi of wrongdoing in a previous embezzlement case. She’s been part of this case ever since she filed for divorce from her estranged husband Thomas Girardi. The Los Angeles-based attorney has been accused of embezzling funds from his previous clients of Girardi Keese law firm. Just because the court cleared Erika from this particular case doesn’t mean she’s safe.
She may find herself involved in another embezzlement suit. The Real Housewives of Beverly Hills star was dragged into a series of lawsuits against her former husband. Attorney Jay Edelson took to Twitter to say that he’s not “letting [her] off the hook” anytime soon.
Erika Girardi faced with another fraud and embezzlement lawsuit
This time, Erika Girardi will have to deal with another fraud and embezzlement lawsuit that takes place in her home state of California. This comes after a judge dismissed another case against her in Illinois. In December 2020, law firm Edelson PC filed a lawsuit against Erika and her estranged husband Thomas Girardi in an Illinois federal court. The lawsuit was filed on behalf of the families and victims involved in the 2018 Boeing plane crash.
According to the court documents obtained by People, Erika Girardi and Thomas Girardi allegedly embezzled funds meant to help the victims of the Lion Air Flight 610. The suit also claims that the former couple used their divorce announcement to “hide and divert assets.” Erika still denies those claims, including any wrongdoing. On Saturday, January 29, the latest court filing dismissed the previous claims against Erika “without prejudice.”
However, that only reveals that Edelson PC can refile a new claim. Jay Edelson took to Twitter to explain the decision. They only dropped the case in Illinois. This allows the law firm to refile in California. So, that means Erika is not out of the woods yet.
RHOBH star still dealing with legal drama
Jay Edelson made it clear that Erika Girardi has not been let off the hook yet. He claims to have found damning evidence against her. The lawyer believes that victims will receive their money.
“No way are we letting this go,” he continued in a follow-up tweet. “(But as we told the court, we are exploring this settlement. Every dollar will go to the victims.)”
Edelson PC received unaired footage from the Bravo series in regards to Erika Girardi and the case. The team is currently reviewing this evidence. They also have plans to add new information to the complaint and file it in California.
“That should happen over the next few weeks,” Jay Edelson told People. “We are very much looking forward to presenting the full facts of Erika’s relationship to Tom’s Ponzi scheme, including how much money she made off the backs of the widows and orphans of the Lion Air crash.”
Erika Girardi’s lawyer Evan C. Borges calls this dismissal “extremely important.” They will continue to defend her innocence amid this ongoing legal drama. However, this is just one of the legal issues that Erika is dealing with. Thomas and his former law firm, Girardi Keese, were sued by former business partners, which led up to his chapter 7 bankruptcy protection.
