Kelly Clarkson Custody Update: Blackstock Seeks Spousal & Child Support
A California judge granted singer Kelly Clarkson primary physical custody of her two children, River and Remy, shared with ex, Brandon Blackstock. The talk show host will remain in Los Angeles, which she has claimed is the children’s home base. Despite the ruling granting Clarkson primary physical custody; Blackstock is seeking $436,000 a month in spousal and child support.
Custody of Children
Kelly was “pleased” with the judge’s decision to grant her primary physical custody. The judge determined the primary residence of the children to be California. Despite the family quarantining at Blackstock’s Montana residence prior to the divorce filing; their home is in Los Angeles. The judge said, “The court finds that the minor children are not now and have not been residents of Montana and that California is their home state.”
Initial Filing
When Clarkson and Blackstock initially filed for divorce in July they requested joint legal and physical custody of their two children. However, lately, the former couple has not been able to reach a mutual decision in regards to their children. Court documents state, “The level of conflict between the parents has increased.”
Further documents layout Blackstock’s visitation will be the first, third, and fifth weekends of the month. However, Blackstock must visit the children in California. He wants the children to continue to split time between Montana, where Blackstock maintains primary residency, and California. This decision is because “the parties have a difficult time co-parenting due to issues of trust between them.”
Conflict Increasing
A source has stated that “Brandon’s been equally unreasonable in his requests for child and spousal support”. The music manager is seeking $436,000 in monthly spousal and child support. The source said, “Kelly’s offered to pay for all the kids’ expenses, but Brandon seems to think he is entitled to and needs $301K in spousal support […] per month.”
Blackstock has also requested $2 million in attorney fees from Kelly Clarkson. The source affirmed Blackstock’s requests. “[H]e’s the one driving up the cost of the divorce with seven attorneys just representing him alone.” If Blackstock were to be granted his request in the divorce Clarkson would end up paying him over $5.2 million a year.

The Children Come First
Despite Blackstock’s substantial financial requests; taking care of the children remains Clarkson’s first priority. The “Breakaway” singer said that she never saw the divorce and separation coming. Clarkson emphasized this saying, “[I] “Definitely didn’t see anything coming that came, but what I’m dealing with is hard — it involves more than just my heart, it involves a lot of little hearts”. Kelly said, “We know the best thing here is to protect our children and their little hearts”.
A second source echoed Kelly saying, “But Kelly’s primary focus is on doing the best she can to protect the kids”.
