Diddy Attorneys Claim ‘Outrageous Government Conduct’ In Case
Sean “Diddy” Combs is trying to get bail approval again. The judge has repeatedly denied bail for several reasons. However, recent actions by the federal authorities and the prosecution have the defense team with a new argument for why Combs needs bail to offer him a fair case. They claim there is “outrageous government conduct” while Combs is in jail.

Sean ‘Diddy’ Combs’ Attorneys Fighting To Get Him Bail
Attorneys for Sean “Diddy” Combs are fighting the prosecution’s claims that he has been trying to blackmail and manipulate possible witnesses while behind bars. To prove their case, the prosecution claims to have phone call recordings that show him making illegal calls and trying to contact witnesses from jail.
However, the prosecution also overstepped its bounds when they asked the federal authorities to raid Combs’ cell. They captured a lot of notes and papers from his cell, and the prosecution planned to see if they had proof there that he was manipulating witnesses.
The judge shot that down and ordered the prosecution to destroy all its copies of the papers. The defense attorneys claimed this paperwork included attorney-client privilege notes, and the judge seemed to agree. The attorneys also claimed that the prosecution violated Combs’ constitutional rights.
“This search and seizure are in violation of Mr. Combs’ [constitutional] rights,” attorney Marc Agnifilo said (via Billboard). “The targeted seizure of a pre-trial detainee’s work product and privileged materials – created in preparation for trial – is outrageous government conduct amounting to a substantive due process violation.”
Judge Arun Subramanian sided with Diddy and his attorneys despite the prosecution claiming nothing considered privileged was there. They claim there were motivational quotes and birthday reminders. The judge said they can’t use anything they got in the bail hearing on Friday.
Diddy’s Attorney Also Wants Him ‘Unshackled’ In Court
On top of the raiding of his client’s cell, Agnifilo also wants Diddy’s leg shackles removed during the hearings. He claims that seeing him shackled will taint the jury during the case. He also said it would keep him from conversing properly with the defense team.
Agnifilo alleges that the prosecution is trampling on Combs’ rights to a fair trial. “Who authorized a search of Mr. Combs’ sleeping area, personal effects and paperwork?” Agnifilo asked. “Who made the decision to not tell Mr. Combs’ counsel that the U.S. Attorney was in possession of his notes, including ‘possibly privileged materials’ until after the government put them in a filing to keep him incarcerated?”
In the bail hearing on Friday, both sides will argue their case. The prosecution feels that if freed, nothing will stop Diddy from targeting the witnesses in the case. The defense claims that as long as he is in jail, the prosecution can still violate his right to a fair trial.
