Judge Finds In Favor Of Diddy After Feds Raid Jail Cell
Things in the Sean “Diddy” Combs criminal case are getting out of control. Prosecutors have accused him of trying to blackmail and pay off witnesses. His own attorneys have accused the prosecutors of violating his attorney-client privilege. In that last concern, the judge actually sided with Combs.
Here is what happened when the feds raided Combs’ cell and took what might be attorney-client privileged information.
The Feds Raided Sean ‘Diddy’ Combs’ Cell & Took Notes & Paperwork
Prosecutors in the case against Sean “Diddy” Combs have made allegations that he is trying to blackmail potential witnesses and taint the jury pool. They claim he is doing so by paying other inmates to use their phone credits and then using three-way calls to speak to people not on his approved list.
They also claim they have recorded phone calls proving he did so. After this happened, they got the feds to raid Combs’ cell, where they took several notes and messages he had on paper. The feds then turned all this over to the prosecution.
There is one problem. The defense attorneys claim that some of those notes and papers are messages between them and Combs. Those messages and notes are protected under attorney-client privilege, and the prosecution team has no right to have them or see them.
The judge in the bail hearing agreed with the defense team and sided with Diddy in this situation.
The Judge Won’t Allow Prosecutors To Use The Information In The Hearing
Judge Arun Subramanian ruled that he would not consider any evidence brought by the prosecution from the sweep of Sean Combs’ jail cell for his bail hearing. He also ruled that the prosecution has to destroy copies of the 19 pages of notes obtained in the sweep.
This is a huge win for Combs. His defense attorneys said that taking these notes and papers was a “due process violation.” The papers included Combs’ notes for his attorneys concerning their strategies. “When we visit him in jail, we have lists,” attorney Marc Agnifilo said (via PEOPLE). “Everything in these pads is things we discuss: trial strategy, who we should speak to, to undermine a witness’s credibility. We discuss everything with Mr. Combs.”
However, the prosecutors claimed that nothing like that was in what they got from the sweep. They claimed that most of what they got was not legally privileged and included things related to personal matters, including birthdays and “inspirational quotes.”
This makes it sound like they found nothing to support their claims of blackmail or coercion in the sweep. The next bail hearing for this case will occur on Friday, November 22.
