Rachael Ray Gave Husband Power Of Attorney Before Health Issues
TV personality Rachael Ray recent has recently become the subject of health concerns. Since then, it’s also come to light that her husband, John Cusimano, was granted power of attorney before their 2005 marriage. A Beverly Hills attorney has also spoken out about the measure.
Rachael Ray Granted Her Husband Power Over ‘Real Estate Transactions’
Fans have recently shared concern for Ray after she appeared to be slurring her words in her cooking videos. However, court papers revealed she filed for Cusimano to be her power of attorney long before these concerns came to light.
Notably, it’s believed that these papers were filed before Ray married Cusimano. The two notably tied the knot in 2005 while in Tuscany.
The papers, which were acquired by The U.S. Sun, read: “The powers you grant below continue to be effective should you become disabled or incompetent.”
As it continued, “Caution: This is an important document. It gives the person whom you designate (your agent) broad powers to handle your property during your lifetime. This could “include powers to mortgage, sell, or otherwise dispose of any real or personal property without advance notice to you or approval by you.” It was also noted, “These powers will continue to exist even after you become disabled or incompetent.”
However, it was also noted that, “This document does not authorize anyone to make medical or other health care decisions. You may execute a health care proxy to do this.”
Notably, Ray only directly granted her husband power over “real estate transactions.” It does not directly grant him control over banking or estate transactions, for example. Should Cusimano become “unable or unwilling to serve,” Ray also did not appoint another in his place.
A Beverly Hills Attorney Discussed Ray’s Reasoning
The document was signed off by both Ray and on July 19, 2005. This was just weeks before their marriage, which took place on September 24, 2005. The court officially recorded the document in early December that year.
Speaking with The U.S. Sun, Beverly Hills attorney Adam Michael Sacks also shed some light on the situation. As he noted, “The power of attorney can make certain decisions. There are certain things you have to sign if you own a house that needs to be sold and you’re, for example, in a coma. With power of attorney, it lets that person sign for you.”
Sacks also mused on Ray’s reasoning for granting her husband power of attorney. Putting himself in her position, he noted, “I’m a chef, I can’t deal with money, I trust my husband or lawyer, he can take care of it.”
Cusimano is a lawyer, and Ray has mentioned in the past that he helps her with legal matters. On her podcast, “I’ll Sleep When I’m Dead,” Ray shared that, “One of the things that has been essential to my life and my success, over the years has been the partner that I chose.”
As Ray continued, “I love my husband, John. And John works with me and has built our business and our brand together. She also claimed that “we balance each other in a weird way. We allow each other to be open to different worlds.”
