Josh Duggar Claims ‘Illegal’ Photos Were Taken Of Him Behind Bars
As we’ve reported, Josh Duggar was arrested by the federal government for the possession of child pornography. The former TLC star is now awaiting his trial, which is slated for November 30.
Now, Josh’s attorneys are building a defense for him. They are gathering evidence and attempting to keep him from ending up behind bars for a couple of decades. Most recently, Josh’s attorneys called for the charges to be dropped and the evidence to be suppressed.
As of right now, we don’t know what’s going to come of Josh’s case and whether he’s guilty or innocent. He has pled not guilty, and his wife Anna Duggar also believes he’s innocent.
According to Josh’s attorneys, when he was arrested, his phone was taken. This means that Josh didn’t have a chance to call his lawyers regarding his arrest. He was reportedly questioned before having a chance to speak with his lawyers.
Josh Duggar wants ‘illegal’ evidence suppressed.
According to The Sun, Josh is attempting to have “illegal” evidence in his case suppressed. When Josh was in police custody on April 29, 2021, three photos were taken of his hands and feet.
His defense filed a motion to have the “photographs law enforcement took of Duggar’s hands and feet while requiring him to pose for the photographs in custody.”
His attorneys state that law enforcement “did not have a warrant which authorized the taking of the photographs” and that they were taken without his lawyer present.
According to the papers, the government “must obtain a warrant which permits photographing a defendant’s body parts (other than a simple booking photograph) and to permit requiring a defendant to pose in a particular manner for these types of photographs.”
His attorneys stated that his body was “manipulated and he was required to pose for the photographs.” They say it’s an “intrusion on [his] personal rights.”
Because of all of this, his attorneys believe that the evidence should be suppressed. They point out that it’s Josh’s legal right to have the opportunity to speak with his lawyers before being interviewed or having photos taken.
