The View host, Sunny Hostin, is going through some troubles at home. Sunny’s husband, Emmanuel “Manny” Hostin, was named in an insurance fraud lawsuit. The suit is based in New York City, and he finds himself in a lot of trouble if the claims have any merit.

Sunny Hostin’s Husband Named In Fraud Lawsuit

A lawsuit in New York City listed almost 200 defendants in an insurance fraud lawsuit. One of the defendants is Sunny Hostin’s husband, Emmanuel “Manny” Hostin. He works as an orthopedic surgeon based at New York’s Mount Sinai Morningside and Mount Sinai West Hospitals.

The lawsuit, filed on December 17, 2024, claims that the doctors included committed insurance fraud by “getting kickbacks by performing surgery and … billing a company that insured taxi companies and Uber and Lyft drivers” (via Daily Mail).

The lawsuit states, “Hostin knowingly provided fraudulent medical and other healthcare services including arthroscopic surgeries.” It also claims that insurance firm American Transit was then billed “in exchange for kickbacks and/or other compensation which were disguised as dividends or other cash distributions.”

While he has not spoken publicly about the lawsuit, Manny’s attorney, Daniel John Thwaites, said his client “denies each and every allegation.” He also said the lawsuit is a “blanket, scattershot, meritless lawsuit by a near-bankrupt insurance carrier.”

The attorney said the lawsuit was meant to “intimidate and harass” doctors from collecting for care given to the insured. He said that American Transit “rushed into the lawsuit without ever conducting an examination of Dr. Hostin or expressing any concerns to his lawyers.”

Who Is American Transit In Sunny Hostin’s Husband’s Lawsuit?

Manny’s attorney said this insurance company is trying to restrict health care benefits to its insured. American Transit Insurance Co. is a New York-based insurer that covers taxis, traditional livery vehicles, and vehicles used in connection with ride-sharing apps like Uber and Lyft.

According to the company, the defendants “engaged both individually and as part of a conspiracy to submit thousands of fraudulent insurance claims” (via SPGlobal). American Transit is seeking $153 million in compensatory damages and punitive damages. The company filed the lawsuit under the RICO Act, which is the racketeer-influenced act.

New York has a “no-fault auto insurance law.” This requires insurers to reimburse policyholders for “the cost of necessary and documented medical care.” This could be as high as $50,000 for personal or private vehicles. It is up to $200,000 for taxis and ride-share vehicles – no matter who is at fault.

The company claims several “staged accidents and fraudulent medical billing.” However, Uber sued American Transit last February for failing its named insureds and refusing to resolve claims. State regulators declared American Transit insolvent after it reported a net loss of $705 million in the second quarter. This is why Manny’s attorneys claim the company is suing – to recoup their losses.
