Josh Duggar’s Attorneys Request Dismissal Of Child Porn Charges
Josh Duggar was arrested for the possession of child pornography a few months ago. Now, he’s waiting for his trial in November. In the meantime, he must stay with a guardian, stay away from children, and wear a GPS tracking device at all times.
In anticipation of his upcoming trial, his legal team is currently building a defense. So, new details about the case have recently surfaced. Josh is pleading not guilty, but the trial hasn’t even begun. There’s still work for his attorneys to do leading up to the trial. As his team attempts to defend him, they are looking for any possible opportunity to make sure he doesn’t end up behind bars.
Now, they’re hoping they can have the case dismissed entirely.
Josh Duggar wants the case dismissed and statements suppressed.
According to the Northwest Arkansas Democrat Gazette, Josh’s attorneys have filed two motions to dismiss the case. They have also filed three motions to suppress the evidence in the case.
The first motion is to dismiss the case because when the other suspects were investigated, no data was saved from their devices. As we reported, there were a few other employees who would have had access to the internet at Josh’s car lot. Josh’s attorneys believe there could have been evidence on their devices.
The second motion states that the two acting secretaries of the U.S. Department of Homeland Security weren’t properly appointed under the designated order of succession to serve when the prior Secretary Kirstjen Nielsen resigned.
The other three motions have to do with the evidence that investigators found. One states that investigators misled the judge about the computer files downloaded from Josh’s computer. This is how the investigators were able to get a search warrant. According to the motion, the investigators waited too long to examine the devices, and the warrant became stale.
There’s another motion that would suppress Josh’s statements because his phone was seized before he could call a lawyer. Because of this, his lawyer wasn’t present.
When Josh was arrested, photos of his hands and feet were taken. Once again, his lawyers weren’t present, which is why they filed a motion.
